Eine Teilnahme an den Gewinnspielen ist ausschließlich zu den hier aufgeführten Teilnahmebedingungen möglich. KG behält sich vor, das Gewinnspiel zu jedem Zeitpunkt abzubrechen oder zu beenden.

Teilnahmeberechtigt sind Personen, die bei der Teilnahme mindestens 18 Jahre alt und Ihren Wohnsitz in Deutschland, Österreich, den Niederlanden, Finnland, Slowenien, Griechenland, Frankreich, Belgien, Spanien, Italien, Irland, Luxemburg, Portugal oder den USA haben. Von der Teilnahme ausgeschlossen sind Mitarbeiter und Familienangehörige von beyerdynamic GmbH & Co. KG.

Eine wirksame Teilnahme am Gewinnspiel liegt dann vor, wenn die im Beitrag formulierten Bedingungen erfüllt sind. Durch die Teilnahme erklärt der Teilnehmer sein Einverständnis mit den hier stehenden Teilnahmebedingungen.

Die Teilnahme am Gewinnspiel beinhaltet das Einverständnis zur Nennung des Vornamens auf der beyerdynamic Facebook / Instagram / X oder LinkedIn Fanpage und / oder auf der beyerdynamic Webseite im Gewinnfall.

Beiträge zur Teilnahme am Gewinnspiel dürfen keine Beleidigungen, falsche Tatsachen, Wettbewerbs-, Marken- oder Urheberrechtsverstöße enthalten.

Teilnahmestart und -schluss sind im Gewinnspiel-Beitrag entsprechend definiert.

Die Bekanntgabe der Gewinner erfolgt ohne Gewähr.

Die Gewinner werden nach dem Zufallsprinzip (Auslosung) ermittelt und via Facebook, Instagram, X, LinkedIn, Blog oder Mail persönlich über den Gewinn benachrichtig. Erfolgt keine Rückmeldung bis 48 Stunden nach Benachrichtigung, verfällt der Gewinn. Aus logistischen Gründen werden die Preise nur an Adressen innerhalb Europas versandt.

Pro Teilnehmer ist nur ein Gewinn möglich, der nicht alternativ in bar ausgezahlt werden kann. Gewinnansprüche sind nicht auf andere Personen übertragbar. die beyerdynamic GmbH & Co. KG. wird mit Aushändigung des Gewinns von allen Verpflichtungen freigestellt.

Der Teilnehmer bzw. die Teilnehmerin erklärt, nur Materialen (Texte, Bilder, Videos etc.) zur Verfügung zu stellen, bei denen er bzw. sie über alle erforderlichen Rechte (insbesondere Urheberrechte) verfügt. Im Falle eines vorsätzlichen oder grob fahrlässigen Verstoßes gegen Rechte stellt der Teilnehmer die der beyerdynamic GmbH & Co. KG. von allen Ansprüchen gleich welcher Art frei, die von Dritten wegen Rechtsverletzung auf Grund der von Teilnehmern im Rahmen eines Gewinnspiels veröffentlichten Inhalte erhoben werden. Die beyerdynamic GmbH & Co. KG. behält sich das Recht vor, eingesendete Beiträge, Nachrichten, Fotos oder Videos etc. zu überprüfen und zu löschen, falls diese gegen gesetzliche Bestimmungen verstoßen oder Rechte Dritter verletzen. Insbesondere sind folgende Inhalte verboten:

- Texte, die rassistische, sexistische, beleidigende, verleumderische, volksverhetzende oder pornografische Tendenzen erkennen lassen, oder die Drohung oder sonst in irgendeiner Form strafrechtlich relevante Inhalte haben,

- Texte, die auf sonstige Weise ehrverletzend sind oder andere Personen angreifen,

- Texte, die als Spam zu betrachten sind,
Beiträge, die Urheber-, Persönlichkeits- oder Kennzeichenrechte Dritter verletzen oder mutmaßlich verletzen oder gegen sonstige Gesetze verstoßen.

Der Teilnehmer verpflichtet sich insbesondere, auf das sogenannte Recht am eigenen Bild zu achten und insbesondere keine Abbildungen, insbesondere Fotos und Videos von Personen hochzuladen, die ihm nicht ihre ausdrückliche Einwilligung erteilt haben. Die rechtliche Verantwortung liegt ausschließlich beim Teilnehmer.

Schadenersatzansprüche gegenüber der Veranstalterin, die im Zusammenhang mit dem Gewinnspiel stehen, sind - innerhalb des gesetzlich zulässigen - unabhängig vom Rechtsgrund ausgeschlossen, es sei denn, der Veranstalter hätte vorsätzlich oder grob fahrlässig gesetzliche Pflichten verletzt. Ferner haftet die Veranstalterin nicht für Schäden aus der Beeinträchtigung der Verfügbarkeit der Gewinnspiel-Internetseite bei nicht beeinflussbaren technischen Störungen und Ereignissen höherer Gewalt, sowie Angriffen Dritter gegen die Gewinnspiel- Internetseite. Die Veranstalterin wird jedoch alles unternehmen, um die Zuverlässigkeit und Funktionsfähigkeit der Gewinnspiel- Internetseite sicherzustellen. Weiterhin übernimmt die Veranstalterin keine Garantie dafür, dass die Gewinnspiel-Internetseite auf dem jeweiligen Teilnehmerrechner ordnungsgemäß funktionsfähig ist.

Soweit im Rahmen des Gewinnspiels personenbezogene Daten von Teilnehmern erhoben, verarbeitet und genutzt werden, werden diese von beyerdynamic GmbH & Co. KG ausschließlich zum Zwecke der Durchführung des Gewinnspiels erhoben, verarbeitet und genutzt und nach Beendigung des Gewinnspiels gelöscht.

Der Teilnehmer stellt Facebook, Instagram, X oder LinkedIn von jeder Haftung frei. Der Rechtsweg ist ausgeschlossen. Es ist ausschließlich das Recht der Bundesrepublik Deutschland anwendbar. A prize draw entry shall be considered valid when the conditions described in the post are fulfilled. By taking part the entrant declares their agreement with the terms and conditions described here.

The announcement of prize draw winners is subject to error.

The winners are drawn at random (prize draw) and notified in person via Facebook, Instagram, X, LinkedIn, Blog or Mail. If there is no response within 48 hours of notification the prize shall be forfeited. For logistical reasons, prizes shall only be shipped to addresses within Europe and the United States.

The data employed to enable notification of winners is captured, stored and used exclusively for this prize draw, and subsequently deleted. Each entrant is entitled to one prize only, and there is no cash equivalent available. The right to any given prize may not be transferred to any other person. Once the prize has been presented, beyerdynamic GmbH & Co. KG has no further obligations.

Claims for compensation against the organizer, which are in connection with the competition, are - within the legally permissible - excluded, regardless of the legal grounds, unless the organizer would have intentionally or grossly negligent violated statutory obligations.
